This Privacy Policy (“Policy”), effective April 5, 2012, identifies and describes the way CellTrust® Corporation (“CellTrust”) uses and protects the information we collect about purchasers of our products and services (“Customers”) and visitors to our website (“Users”) and the choices you can make about the way your information is collected and used.  We have structured our website so that, in general, you can visit it without revealing any information by which you may be identified (“Personal Information”).  We may require, however, that you provide Personal Information to access certain secured and detailed information, download certain software, make certain transactions, or request our products or services.  Once you choose to provide your Personal Information, we will use it only as set forth in this Policy.  To make this Policy easy to find, we make it available on the bottom footer of every page of our website.  We are committed to respecting and protecting your privacy and security online, and so we adhere to the Mobile Marketing Association's Code of Conduct for Mobile Marketing.

By using our website, you consent to our collection and use of your Personal Information as set forth in this Policy or the Privacy Policy then in effect.  If you do not accept the terms of this Policy, please do not use the CellTrust website, products, or services.  CellTrust expressly reserves the right to change this Policy from time to time, and any such change will be posted on the CellTrust website.  We recommend that you check the website frequently to ensure that you have the most current Policy.

Who Collects Your Personal Information
If you are on a CellTrust website page and you respond to a request for Personal Information, generally you are sharing that Personal Information with CellTrust.  If you purchase products or services or receive materials from CellTrust, your Personal Information may be collected by a third-party company working with CellTrust.  CellTrust may also contract with third-party companies to perform services for CellTrust on its website that require these companies to collect Personal Information.  CellTrust always uses reputable third parties to perform such services.

The CellTrust website may contain links to third-party websites that provide additional products, services or other information.  CellTrust does not own or operate these third-party websites and this Policy does not cover them.  These third-party websites may have their own privacy and data collection policies and practices, and any information you provide to these websites is governed by such policies and practices.  CellTrust is not responsible or liable for the content, independent actions, practices, or privacy policies of these third-party websites.

The Personal Information We Collect
We may collect various types of Personal Information relating to our business relationship with you, including but not limited to:

  • Contact Information – your name, company name, address, telephone numbers, e-mail address, and contact preferences;
  • Financial and Sensitive Information – your credit card numbers, bank account numbers, other account numbers, passwords, flight numbers, driver's license number, date of birth, and other sensitive information; and
  • Performance, Research, Usage, and Other Technical Information – your demographics, personal and professional interests and experience with our products and services, as well as information about website feature popularity, domain names, internet protocol addresses, types of web browsers, and click stream data.

Please be aware that the Personal Information we collect and other information you submit is stored and processed on computers in the United States.  The laws on collection, holding, or processing of personal data in the United States may be more or less stringent than the laws of your country.  CellTrust does not warrant or represent that it complies with the laws regarding the collection, holding, or processing of personal data in your country.  If you do not accept this term or other terms of the Privacy Policy, please do not use the CellTrust website, products, or services.

How We Collect Personal Information
We collect Personal Information either by requesting it from you when you purchase or interact with us about our products and services, or automatically when you use our products and services or visit our website.  The CellTrust website also may contain optional surveys, questionnaires, and opportunities for visitors to ask questions seeking Personal Information.  In addition, some CellTrust website pages use cookies to collect information.  (For more on cookies, please see the “How We Use Your Personal Information” section below.)  Finally, our Web server storage logs can collect the domain names, internet protocol addresses, the types of web browsers, and certain click stream data of visitors to our website.

How We Use Your Personal Information
CellTrust uses your information to better understand your needs and provide you with personalized and customized services and products.  With respect to transactions, CellTrust uses Personal Information to facilitate order processing, including but not limited to updating you on service and benefits, personalizing our website pages for you, and contacting you if necessary.  At your option, we also may use your Personal Information to contact you for market research or to provide you with marketing information.  We will give you the opportunity, however, to opt out of receiving such direct marketing or market research contact.  We will also follow local requirements such as allowing you to opt in before receiving unsolicited contact.  CellTrust never will subscribe you to a mobile messaging program unless you opt in to such a program.  Further information regarding marketing or market research contacts is available in our Anti-Spam Policy.

CellTrust also may conduct research on our Customers' and Users' demographics, interests, and behavior based on the information you provide.  This research is compiled and analyzed on an aggregate basis to prevent identification of Personal Information relating to any one individual.  We conduct such research to better understand and serve our Customers and Users.  Regarding the collection of domain names, internet protocol addresses, types of web browsers, and certain click stream data of visitors to our website, we use this information only internally to measure, for example, the number of visits and average time spent on the CellTrust website.  This information also may assist CellTrust in diagnosing problems with and administering the website.

In addition, CellTrust uses cookies to analyze Web traffic and let us know when you visit a particular website.  Cookies are pieces of text asking permission to be placed on your computer's hard drive.  If you agree, then your browser adds the text in a small file.  Cookies allow a Web application to gather and remember information about your preferences and tailor its operation to your needs, likes, and dislikes.  CellTrust may use traffic log cookies to gather information about how our Customers and Users navigate our site and to determine common traffic patterns.  We also may use this information to better personalize the content, banner ads, and promotions that Customers and Users see on our website.  CellTrust uses this information only for statistical analysis purposes.

Sharing Your Personal Information
Except as outlined in this Policy or allowed or required by law, CellTrust will not sell, rent, lease, or otherwise share your Personal Information without your consent.  We share your Personal Information with other CellTrust entities, business partners, and authorized third parties acting on our behalf for the uses described in this Policy.  In addition, when you register your account or purchase CellTrust products or services, CellTrust may share aggregated Customer and User statistics and information with certain reputable third parties.  Such information may include our Customers' and Users' demographics, interests, browsing and purchasing behavior, and Personal Information.

CellTrust also may disclose Personal Information in special cases to identify, contact, or bring legal action against a person or entity that violates our website's Terms of Use or this Policy, violates CellTrust's or others' rights, or causes injury to or interference with CellTrust's or others' property.  In addition, CellTrust may disclose aggregated Customer or User statistics for other lawful purposes.

It is possible that CellTrust will acquire, merge with, or be acquired by another company.  If such an action occurs, the resulting entity would have access to Personal Information and other information collected and stored by CellTrust and would be bound by this Policy.

Your Choices Regarding Collection, Use and Distribution of Personal Information
As stated above, except as outlined in this Policy or allowed or required by law, CellTrust will not sell, rent, lease, or otherwise share your Personal Information without your consent.  In addition, we will provide you the opportunity to opt out of receiving unsolicited direct marketing materials from us.  Occasionally, you may receive materials related to promotions or contests that include targeted advertisements.  If you do not wish to receive such advertisements, you can choose not to participate in such promotions or contests.  CellTrust never will subscribe you to a mobile messaging program unless you choose to opt in to such a program.  If you have any questions regarding materials you receive from CellTrust or one of our business partners, or if you want to be removed from a contact list, please e-mail us at marcom@celltrust.com.

You also have choices with respect to cookies. By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject all cookies, you will be unable to use the services or engage in the activities that require the placement of cookies.  Accepting a cookie in no way gives CellTrust access to your computer or any Personal Information other than the data you choose to share with us.

Protecting Your Personal Information
CellTrust is dedicated to protecting your Personal Information and holds, processes, and transmits your Personal Information in a confidential and secure environment.  We use secure technology to safeguard your Personal Information, including but not limited to Secure Sockets Layer (SSL), the industry standard security protocol.  We also maintain a certificate of authority that serves as an electronic substitute for your signature, and all of your ordering information is protected using our secure server for maximum security.  When authorized third parties need access to some of your Personal Information, we only provide them with the minimum amount of information needed to complete the requested service or transaction.

The security of the Personal Information you provide to CellTrust depends in part on the password you choose for the CellTrust website, products, and services.  Never disclose your password to anyone, and make sure you choose a password that is not obvious to or easily ascertainable by another person.  CellTrust never will request that you send your password to us via email, but you will be required to enter your password on the CellTrust website and when using certain CellTrust products and services.

Accessing and Correcting Your Personal Information
CellTrust strives to keep your Personal Information accurate.  Once you have registered on the CellTrust website, we provide you with access to your Personal Information on the website so that you may review, update, or correct it at any time.  To protect your privacy and security, we will also take reasonable steps to verify your identity before granting you access to your Personal Information.  You also may review, update, or change your Personal Information by contacting us at marcom@celltrust.com.

CellTrust's Commitment to Protecting Children's Privacy
CellTrust takes special care to protect the privacy needs of children under the age of 13 by abiding the Children's Online Privacy Protection Act (COPPA) requirements.  CellTrust does not knowingly collect information about children under the age of 13, and Users under the age of 13 should not submit or post information on the CellTrust website.  If CellTrust discovers that a child under the age of 13 submits Personal Information to the CellTrust website, we delete that information as soon as we discover the source of the submission and do not use it for any other purpose.  CellTrust encourages parents to take an active role in their children's use of the Internet and cellular telephones and to inform them of the dangers of providing information about themselves on the Internet.  We recommend that parents teach their children to never give their Personal Information on the Internet unless supervised by a parent or responsible adult.  Parents should also know the websites their children are visiting and read website privacy policies to understand how they treat their children's Personal Information.

Your California Privacy Rights
California legislation requires that certain disclosures be made available to California residents who provide information over the Internet that is used for direct marketing purposes. Specifically, any business that discloses a customer's personally identifiable information to a third party for direct marketing purposes is required to provide a method for the customer to obtain the names, addresses, and certain other information for such third parties. CellTrust will meet the requirements of U.S. laws regarding the number of such requests to which it must respond per customer per calendar year.
